The petitioner apprehends his arrest in Ramgarhawa P.S. Case No. 163/2014, registered for the offences punishable under Sections 406 and 420 and other Sections of the Indian Penal Code.
The petitioner was appointed as Rural Collector of electric charge from different consumers. The informant alleged that petitioner did not hand over money receipt book and D.C.R. The petitioner collected money of electricity charge from different consumers but did not deposit the same.
It is submitted that petitioner fell ill and

No.8163 of 2015 (2) dt.02-03-2015 therefore he could not deposited the same but later on petitioner deposited D.C.R. book and the money in the office of Assistant Electrical Engineer, Raxaul. The Assistant Electrical Engineer, Raxaul wrote a letter to Executive Electrical Engineer that petitioner deposited the D.C.R. book and the amount received by him from different consumers.
Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran, in connection with Ramgarhawa P.S. Case No. 163/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
