JUSTICE SUDHIR SINGH ORAL ORDER 19-04-2017 Earlier the bail application of the petitioner was rejected vide order dated 31.08.2016 in connection with Sessions Trial No. 597 of 2015, corresponding to Minapur P.S. Case No. 190/2013, pending in the court of learned 9th Additional Sessions Judge, Muzaffarpur, with a direction to the court below to conclude the trial within a period of six months from the date of receipt/production of a copy of the order.
The court below vide its Letter No. 300 dated 29.03.2017 has sought for further extension of six months' time for concluding the trial. It is further evident from the aforesaid letter that due to non production of this petitioner the trial was held up. After issuance of show cause by the court below to the Jail Superintendent, Central Jail, Muzaffarpur, the Jail Superintendent has produced this petitioner on 24.03.2017.
Patna High Court Cr.Misc. No.20451 of 2016 (6) dt.19-04-2017 2/2 The court below is granted further a period of six months time to conclude the trial from the date of receipt/production of a copy of this order.
The District Magistrate, Muzaffarpur and the Senior Superintendent of Police, Muzaffarpur, are directed to ensure that the remaining prosecution witnesses are produced on the date fixed by the court below so that the trial could be concluded within the stipulated period.
Let a copy of this order be communicated to the District Magistrate, Muzaffarpur and the Senior Superintendent of Police, Muzaffarpur.
