Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Srinagar P.S. Case No. 56 of 2019, registered for the offences punishable under Sections 341, 323, 324, 307, 354 (B), 504, 506, 379 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. Though, there is allegation against him that he assaulted the husband of the informant with axe on his head but the injuries are simple in

He has further submitted that his anticipatory bail petition was rejected by the learned Sessions Judge, merely because there was a mistake in paragraph No. 2 of the bail petition and inadvertently it was left to be mentioned that earlier his bail petition was rejected by the Sessions Court, his A.B.P. was rejected by the court below.

Considering the above-mentioned facts and circumstances as well as clean antecedent of the petitioner, let him, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Srinagar P.S. Case No.56 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
