2. The petitioner apprehends his arrest in a case registered for the offence under Sections 414/34 of I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act.

3. 276 liters of illicit foreign liquor has been recovered from two motorcycles and one tractor.

4. It is submitted on behalf of petitioner that petitioner is neither owner nor driver of any of the vehicles in question and has been made accused only on suspicion.

5. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got two criminal antecedent, out of which, one case is of similar nature.
