JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409, 420/34 of the Indian Penal Code.

The prosecution case is that in pursuance of an order passed by this court in a PIL, vigilance enquiry was initiated with regard to illegality in appointment of Panchayat Teachers. The Panchayat Secretaries were directed to submit folder of all appointed Panchayat Teachers. The petitioner failed to supply the folder to the investigating agency.

It is submitted by the learned counsel for the petitioner that the petitioner joined as Panchayat Secretary of Hussena and

Patna High Court Cr.Misc. No.20457 of 2016 (2) dt.12-05-2016 2/2 Mir Nagar on 01.08.2012 and 21.08.2012 and he was not given charge of folders which were to be supplied to the investigating agency. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation coupled with the fact that petitioner was not given charge of alleged folders, which were to be supplied to the investigating agency, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Nalanda at Biharsharif in connection with Sarmera P.S. Case No. 17 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) BKS/- U T
