JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-08-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Baniyapur P.S. Case No. 115 of 2019 for the offenses under Sections 413 and 414 of the Indian Penal Code. Allegation against the petitioner is that a Bolero vehicle without any registration number was seized by the police on suspicion and the petitioner was intercepted and others sitting in the vehicle managed to escape taking advantage of darkness.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.04.2019.

Considering the fact that the petitioner has remained

Patna High Court CR. MISC. No.48753 of 2019(2) dt.05-08-2019 2/2 in custody for nearly four months, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 11, Saran, Chapra in connection with Baniyapur P.S. Case No. 115 of 2019.
