Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends her arrest for the offences alleged under Sections 341, 323, 354(B), 504 and 506 of the Indian Penal Code, registered in connection with Shahjahanpur P.S.Case No.47 of 2022.

As per allegation, the petitioner dashed the informant and abused and assaulted her.

The learned counsel for the petitioner has submitted that she has falsely been implicated in this case. As a matter of fact, the cousin brother of the informant had kidnapped the sister of the informant and for that the father of the petitioner had lodged a case against the informant's side, which was the

Patna High Court CR. MISC. No.51276 of 2022(2) dt.19-01-2023 2/2 reason of false implication of the petitioner. He has submitted further that the aunt of the informant has filed a case, which was registered under bailable Sections of the IPC and in that case the petitioner is on bail.

On the other hand, learned APP has opposed the prayer for anticipatory bail.

Considering the above facts and circumstances, let the petitioner above-named, in the event of her arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Miss Peeyush Payal, J.M. 1st Patna City, Patna in connection with Shahjahanpur P.S.Case No. 47 of 2022, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
