JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2016 Petitioner being mother of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 341, 324, 326, 307, 498A of the Indian Penal Code. Subsequently Section 304B I.P.C was also added.
The prosecution case is of killing the informant for non-fulfilment of the dowry demand by causing burnt injuries. It is specifically alleged that Rizwan Ansari, the husband of the informant caught hold of her and this petitioner being mother-in-law of the victim poured kerosene oil and the firing was lit by the husband of this petitioner. It is submitted by learned counsel for the petitioner that the marriage was performed eight years prior to the death. Hence, the case does not come within the purview of Section 304B I.P.C and the petitioner is lady.
Patna High Court Cr.Misc. No.20113 of 2016 (2) dt.05-05-2016 2/2 Considering the nature of accusation, let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bela P.S. Case No. 173 of 2015, pending in the Court of learned Chief Judicial Magistrate, Sitamarhi.
With the observations above, the application stands disposed off.
