The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

There is recovery of 120 litres of Indian made foreign liquor from a Wagon-R car bearing Registration No. BR-06-AG-6127.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner was not apprehended from the

Patna High Court CR. MISC. No.61157 of 2021(3) dt.05-07-2022 2/3 spot nor anything has been recovered from the conscious possession of the petitioner. The name of the petitioner sprang up on the confessional statement of the owner of the vehicle namely Babulal Thakur who confessed that at the time of seizure of illicit liquor, the petitioner was driving the vehicle. It is further submitted that co-accused Babulal Thakur has been granted privilege of bail by a coordinate Bench of this Court vide Cr. Misc. No. 38336 of 2021. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II, Gopalganj in connection with Kuchaikote P.S. Case No.
