Petitioner seeks bail in a case registered for the offences punishable under Sections 399/402 of the Indian Penal Code, Section 25(1-B)a, 26,35 of the Arms Act, Section 3/4 of Explosive Substance Act and Sections 20 & 22 of the NDPS Act.
The petitioner and others were apprehended from the house of the referred person on suspicion that they were planning to commit dacoity. From possession of others, 900 Gms of Ganja etc. were recovered, whereas nothing was recovered from possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.
Patna High Court Cr.Misc. No.45456 of 2018 (2) dt.02-08-2018 2/2 Petitioner is in custody since 07.05.2018. Similarly situated co-accused-Miltan Kumar has already been allowed bail by a Coordinate Bench of this Court in Cr.Misc. No.42941 of 2018.
Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihra Police Station Case No.85 of 2018 corresponding to Special Case No.03 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
