JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Barhariya P.S. Case No. 432 of 2014 registered under Sections 147, 148, 149, 323, 307 and 504 of the Indian Penal Code. The accusation is that due to dispute of catching of fish petitioners along with five others came at the door of informant and started to assault the brother of informant, Lal Bahadur Rangwa. When informant came to save his brother then they also assaulted to the informant. The family members of the informant took the informant and his brother to Barhariya Hospital for their treatment. Learned counsel for the petitioners submits that

No.10960 of 2015 (3) dt.21-05-2015 petitioners and the informant are agnate and the occurrence took place due to catching of fish in which informant and his family members also caused injury to Bal Kishun Rangwa, who is the father of petitioner no. 3, regarding which, Bal Kishun Rangwa lodged the case bearing Barhaiya P.S. Case No. 431 of 2014 on 27.09.2014, under Sections 147, 148, 149, 323, 324, 308 and 504 of the Indian Penal Code, against the informant of the present case and his family members, in which, they are on police bail. It is further submitted that no specific over act has been attributed against the petitioners rather there is general and omnibus allegation against them.

Under the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Barhariya P.S. Case No. 432 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
