Petitioner apprehends his arrest in connection with Minapur P.S. Case no. 462/2014 registered under sections 447, 341, 323, 504, 384, 354 and 427/34 of the IPC.
The allegation against the petitioner is that he along with others assaulted the informant with fists and slaps and also threw belonging of the informant.
The contention on behalf of the petitioner is that the present case has been lodged on account of land dispute and, as a matter of fact, much prior to institution of this case, mother of the petitioner filed Title suit no. 39/2006 against family members of the informant of this case.
Considering the aforesaid facts and circumstances as well as
Patna High Court Cr.Misc. No.10348 of 2015 (2) dt.17-03-2015 submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Minapur P.S. Case no. 462/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
