The petitioner seeks pre-arrest bail in connection with Warisnagar (Mathurapur O.P.) P.S. Case No. 227 of 2017 registered under Sections 447, 341, 323, 354-A, 354-B, 427, 504, 506 and 379 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner and the informant are co-villagers. A dispute relating to land exists between them from before. Since an altercation took place between them, as the cattle of the petitioner damaged some standing crop of the informant, the

Patna High Court Cr.Misc. No.43014 of 2018 (2) dt.20-07-2018 instant case has been instituted giving an exaggerated version. It is further submitted that the petitioner is a sufficiently aged man and has retired from service in 2016.

Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner. Considering the nature of allegation, the submissions made above and the statement made in para-3 of the application that the petitioner has got no criminal antecedent, in the event of arrest or surrender in the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar (Mathurapur O.P.) P.S. Case No. 227 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. Sanjeet/SkSuman.
