Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act and Section 272, 273 and 34 of the IPC.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and allegation is of recovery of 540 litres of liquor from a car.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and is not the owner of the seized vehicle. It is next submitted that he came to be implicated at the instance of Chowkidar but then police, in majority of the cases, implicates either at the instance of

Patna High Court CR. MISC. No.56470 of 2024(2) dt.06-09-2024 2/2 Chowkidar, local person, secret information or confessional statement mechanically without holding a proper investigation and petitioner is in custody since 28-3-2024. 5.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Andhramath P.S. Case No. 57 of 2024.
