The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 147, 148, 149, 452, 307, 323, 379, 504, 506 ,337 of the Indian Penal Code and 3(1)(v)(x) of the SC/ST (Prevention of
Patna High Court Cr.Misc. No.6162 of 2015 (2) dt.03-03-2015 2 / 3 Atrocities) Act.
It is alleged that in the background of land dispute when the informant was constructing boundary wall the accused persons including the petitioners came variously armed entered into the house of the informant and petitioner Pankaj Kumar Singh caused injury with axe to one labour of the informant, namely, Ganesh Pandit whereas Permanand Singh assaulted Simran Kumari, Rajesh Singh took Rs. 10,000/- cash and Rakesh Singh snatched gold chain of the informant.
It is submitted by learned counsel for the petitioners that admittedly in the background of serious land dispute, accusation has been levelled when 144 Cr. P.C. proceeding was also initiated earlier, Title Suit No. 176 of 2014 is also pending between the parties and with similar accusation earlier a case was lodged by the accused persons. The injury of Ganesh Pandit was found to be grievous caused by hard and blunt substance whereas it is specifically alleged in the F.I.R. that Pankaj Singh assaulted with axe and the case was also lodged by petitioners' side at earlier point of time in which several persons including the petitioners received injuries.

Patna High Court Cr.Misc. No.6162 of 2015 (2) dt.03-03-2015 3 / 3 of land dispute, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Bhagalpur SC/ST P.S. Case No. 89 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
