Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 419, 420, 465, 467, 468 and 471 of the Indian Penal Code.

The prosecution case, in brief, is that this petitioner along with eight other accused persons have been appointed on the post of Prakhand Teacher on the basis of forged TET certificate.

Learned counsel for the petitioner submits that the petitioner has already been terminated from service in the year 2016. It has further been submitted that petitioner had applied for TET Examination and after receiving admit card appeared in the examination. It has further been submitted that after verification of document the petitioner has joined his service.

No.52336 of 2022(2) dt.20-12-2022 2/2 Similarly situated accused Sunil Kumar has already been granted pre arrest bail by this court vide order dated 13.02.2020 passed in Cr. Misc. No. 19103/ 2019. The petitioner has no criminal antecedent and he has not committed any offence at all. Learned APP vehemently opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, West Muzaffarpur in Paroo P.S. Case No. 55 of 2017.
