The petitioner is apprehending arrest in a case registered for the offences punishable under sections 379 and 411/34 of the Indian Penal Code.

The prosecution case is that the informant saw 1012 persons coming out from the premises of NTPC with some articles. On warning by the informant, the accused persons including the petitioner showed fire arms and thereafter they jumped from the boundary wall with articles. However, co accused Fantush Mahto was apprehended from whose possession 15 Kilograms of copper coil were recovered.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.20546 of 2016 (2) dt.13-05-2016 2/2 petitioner that only on suspicion the accusation has been levelled against the petitioner. Though the petitioner is accused in five other cases but he is on bail in those cases. Considering the nature of accusation, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Kahalgaon P.S. Case No. 281 of 2015 pending in the court of learned CJM, Bhagalpur. This application is disposed of with the aforesaid observation/direction.
