JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 380, 436, 427, 120B, 147, 148 and 149 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act.

It is alleged that the extremists robbed the articles from the house of the informant and took it away on a tractor and also set the house of the informant on fire. The name of the petitioner sprang up on the confession of the co-accused. It is submitted by learned counsel for the petitioner that for the occurrence of 05.08.2011, the FIR was registered on 10.08.2011.

In view of the fact that the FIR was registered in the year 2011, this Court is not inclined to grant anticipatory bail to

Patna High Court Cr.Misc. No.11539 of 2015 (2) dt.23-03-2015 2/2 the petitioner.

However, since other accused persons have been granted regular bail by this Court vide Cr. Misc. Nos. 45235 of 2012, 43792 of 2011, 42237 of 2011, 1016 of 2012 and 14259 of 2013, this Court finds no reason for the learned court below not to consider the prayer of regular bail of the petitioner if he surrenders within a period of six weeks in connection with Rohtas P.S. Case No. 120 of 2011 pending in the court of learned JM, 1st Class, Dehri, Rohtas.

Accordingly, the application is disposed of.
