JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 27.3.2018 seeks bail in Shambhuganj PS Case No. 55 of 2018 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The allegation in brief is of recovery of two live cartridges. Learned Counsel for the petitioner submits that on account of collision of the motorcycle of the informant and the petitioner side, they have been falsely implicated and only two live cartridges are shown to have been recovered from his possession; however the petitioner has no criminal antecedent and another co-accused Dharmendra Kumar Singh has been granted bail by this Court and the petitioner is in custody since 27.3.2018. Having considered the said facts and circumstances, the petitioner, namely, Sanjeev Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Banka in connection with Shambhuganj PS Case No. 55 of 2018.
