The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, three unknown miscreants boarded on a motorcycle snatched a bag containing Rs. 6,07,700/- from the informant on the gun point. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R . No T.I. Parade has been conducted by the prosecution. The co-
Patna High Court CR. MISC. No.51504 of 2022(2) dt.21-12-2022 2/2 accused person has already been granted bail by the Co-ordinate Bench vide order dated 04.09.2020 passed in Cr. Misc. No. 22123 of 2020. The petitioner is accused in four other criminal cases out of which he is on bail in the aforesaid three cases. The petitioner is in custody since 27.04.2022.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of detention, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Nagar P.S. Case No. 177 of 2020.
The application stands allowed.
