Mr. Ajit Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 29-11-2024 Heard Mr. Chhote Lal Mishra, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar, learned APP for the State.

2. The petitioner seeks regular bail in connection with Sessions Case No.143 of 2022 (arising out of Dehri Town, P.S. Case No. 894 of 2020) registered for the offence(s) punishable under Sections 302, 201/34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that the petitioner was granted regular bail vide order dated 29.08.2022 passed in Cr. Misc. No.23895 of 2022. After having been granted regular bail, his bail bond was canceled on 01.05.2023, on which date, he had not appeared before the learned District Court. However, he submitted that the petitioner has given instruction that he is ready to deposit a

Patna High Court CR. MISC. No.53726 of 2024(2) dt.29-11-2024 2/2 sum of Rs.3000/- into the account of Advocate's Association, Patna High Court.

4. Considering the fact that the petitioner has already been released on bail vide order dated 29.08.2022 passed in Cr. Misc. No.23895 of 2022, as well as, the fact that he has shown his willingness to deposit a sum of Rs.3000/- into the account of Advocate's Association, Patna High Court and in view of the information given on behalf of the petitioner that he has not misused the bail bond in any manner, as he was not informed about the date fixed by the learned Trial Court, the learned District Court is directed to consider the case of the petitioner and accept his bail bond on such terms and conditions as it deems fit and proper.

5. Accordingly, the present bail application stands disposed of.
