2. The petitioner in the present case is seeking prearrest bail in connection with Beldour P.S. Case No. 71 of 2023 registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code. He has no criminal antecedent.
3. As per the prosecution story, on 11.04.2023 at about 08:00 P.M. the minor daughter of the informant was forcibly kidnapped by one Chhotu Kumar with the help of Ranveer Kumar (Petitioner), Chandrika Devi and Devendra Sharma. It is further alleged that when the informant went to the house of Chhotu Kumar to enquire about her daughter, the accused persons started abusing her and were ready to assault her.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.51558 of 2023(2) dt.19-08-2023 2/3 allegation of taking away the daughter of the informant is against co-accused Chhotu Kumar. It is further submitted that no specific allegation has been leveled against this petitioner.
5. Learned counsel submits that one Chandrika Devi who is similarly situated with this petitioner has been granted privilege of anticipatory bail by a learned co-ordinate Bench of this Court in Cr. Misc. No. 51398 of 2023.
6. Learned APP for the State has opposed the prayer for bail of the petitioner.

Having regard to the submission that the allegation of taking away the daughter of the informant is against coaccused Chhotu Kumar who is not before this Court, so far as this petitioner is concerned, there is no specific allegation against him and the co-accused Chandrika Devi who is similarly situated with the petitioner has been granted privilege of prearrest bail by a learned co-ordinate Bench of this Court in Cr. Misc. No. 51398 of 2023, this Court directs that in case of his arrest or surrender within a period of four weeks from today, the petitioner who has otherwise no criminal antecedent be released on bail in connection with Beldour P.S. Case No. 71 of 2023 on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.51558 of 2023(2) dt.19-08-2023 3/3 satisfaction of the learned Judicial Magistrate, Khagaria subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
8. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
