Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 379/34 of the Indian Penal Code.

It is alleged against the petitioner that he

Patna High Court CR. MISC. No.7248 of 2021(4) dt.17-02-2022 2/3 assaulted the informant with iron rod on her head and snatched gold chain and Mangal Sutra and cash of Rs. 10,000/- of the informant.

It is submitted by learned counsel for the petitioner that petitioner is neighbour of the informant and since the petitioner opposed the informant against the encroachment of his land by the informant, hence, this false case has been registered against the petitioner. There is no injury report on record and even in the case diary also, the injury of the informant has not been mentioned. Moreover, for the alleged occurrence of 10.10.2019, the F.I.R has been registered on 22.10.2019.

Considering the aforestated facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the
