It has been submitted by learned counsel for the petitioner that one of the conditions in the order granting bail was that, one of the bailors will be Sanjan Yadav, cousin brother of the petitioner, who has sworn the affidavit in this case. The said Sanjan Yadav is not having any valuable property to furnish before the learned trial court in order to stand surety to the petitioner. The learned counsel further submits that if that condition is modified and mother of the petitioner namely Mrs. Chandan Devi be allowed to stand surety of the petitioner, then the petitioner would get released on bail. Having regard to the facts and circumstances, the condition no. (ii) stands modified and it is ordered that the mother of the petitioner, Mrs. Chandan Devi, will be one of the bailors in place of Sanjan Yadav and the order dated 05.08.2022 is modified to the extent indicated above only. Accordingly, the matter stands disposed of.
