The petitioner apprehends arrest in Complaint case no.319 of 2013 on the allegation that in spite of due payment the petitioner did not execute sale deed and on persuasion he handed over a cheque of Rs.3,00,000/- which bounced due to insufficient fund. Further the petitioner with aid of 3-4 persons threatened the brother of the complainant.

The petitioner denies the allegation stating that no procedure or agreement was worked out for transaction of land in question and the matter is of civil suit.

In the facts of the case, this Court passes following order:- In case the petitioner deposits 33% of the cheque

Patna High Court Cr.Misc. No.28841 of 2014 (6) dt.02-07-2015 2/2 amount i.e. Rs.3 lacs in the form of cash deposit in the court of JM, 1st class, Madhepura, he would be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the court above. In case, the petitioner fails to deposit the said amount, the court would dispose of petitioner's bail petition on its own merit. The deposit is the subject to the result of the complaint case.
