Petitioner, already in custody, seeks bail in connection with Dhanrua (Patna) P.S. Case No.154 of 2018 registered under Sections 341/504 and 363 of the Indian Penal Code as well as under Section 12 of the POCSO Act.
Allegation in brief is that the informant, a girl of 16 years, was going on the road, the accused persons came on a Bolero and lifted her in the vehicle and on alarm raised by her, the police also reached there incidentally and apprehended the accused persons and the girl was also recovered. Learned counsel for the petitioner submits that in fact the informant had some illicit affair with her brother-in-law and when he refused to marry her, she wanted to commit suicide, in

No.44053 of 2018(2) dt.20-07-2018 2/2 the meanwhile, the petitioners noticed and tried to save her, so falsely implicated the petitioners; whereas the learned counsel for the State submits that it is an act committed in the broad day light, the minor girl was lifted by the accused persons in Bolero vehicle with some ulterior motive but apprehended on the spot by the police and the girl has supported the allegation in her statement recorded under Section 164 Cr.P.C.
Having considered the nature of offence and its gravity, the prayer of bail of the petitioner is rejected. (Arun Kumar, J) S.KUMAR/- U T
