Permission is allowed.

The anticipatory bail petition is dismissed as withdrawn.

Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 354, 379, 427, 504/34 of the IPC.

As per FIR, petitioner no. 2 along with all the named accused persons, assaulted the informant and her family

Patna High Court CR. MISC. No.51342 of 2022(2) dt.19-12-2022 2/2 members by means of iron rod and lathi.

Specific accusation against petitioner no. 2 is of snatching gold chain worth Rs. 20000/- from the neck of the informant.

It is submitted that there is case and counter case where both sides sustained injury. Petitioner no. 2 has got clean antecedent.

Counsel for the state vehemently opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner no. 2, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learnedAdditional Chief Judicial Magistrate-III, Biraul, Darbhanga in Ghanshyampur P.S.
