JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 This case has been listed today under the heading "To Be Mentioned" at the instance of the petitioners. It has been submitted by learned counsel for the petitioners is that vide order dated 25.10.2019, petitioners were granted the privilege of anticipatory bail, however, in the said order the details of police station case has inadvertently been recorded as Chowk P.S. Case No. 19 of 2019, whereas, it should have been Chowk P.S. Case No. 34 of 2019 and further the
Patna High Court CR. MISC. No.49235 of 2019(4) dt.11-12-2019 2/2 sections 341 and 379 has also wrongly been mentioned as the as the said case i.e. Chowk P.S. Case No. 34 of 2019 has not been registered under these two sections.
Considering the facts and circumstances of the case, order dated 25.10.2019 is modified to the extent that wherever Chowk P.S. Case No. 19 of 2019 is mentioned in the order dated 25.10.2019, the same shall be read as Chowk P.S. Case No. 34 of 2019 and further paragraph no. 1, of the said order is also modified to the extent that the section 341 and 379 be considered as deleted.
Further four weeks' time from the date of receipt of this order, is allowed to the petitioners to surrender in the court below.
Let a copy of this order be communicated to the concerned court below forthwith.
