Petitioner seeks regular bail in connection with Didarganj P.S. Case No. 259 of 2020, G.R. No. 4445 / 2020 registered under Section 120(b)/34 of the I.P.C. and Section 25 (1-AA) / 26(2) (22) / 35 of the Arms Act.
As per the First Information Report Police got secret information that petitioner along with other accused persons are engaged in manufacturing and sale of illegal fire arms, raided the poultry farm of the petitioner and recovered certain equipments for manufacturing of fire arms as well as semimanufactured arms including manufactured country made pistols, cartridges and other articles.
Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged
Patna High Court CR. MISC. No.51780 of 2022(2) dt.09-12-2022 2/3 and the accused persons, who were arrested from the spot have been granted bail by different Co-ordinate Benches of this Court in Cr. Misc. Nos. 41729 / 2021, 40594 / 2021, 40846 / 2021, 41070 / 2021, 41289 / 2021 , 41653 / 2021 (Annexure-3 Series) including the co-accused / Mukesh Kumar Patel, who is named in the FIR, has been granted bail by A.D.J. III, City Court, Patna vide order dated 23.02.2022 passed in Sessions Trial No. 824 of 2021. He next submits that petitioner had let out the premises for running poultry farm in favour of Mukesh Kumar Patel and rent agreement was also executed between the petitioner and Mukesh Kumar Patel, which would be evident from Annexure2 to this petition. He further submits that petitioner has not been arrested on the spot and he has surrendered before the court below subsequently.
Regard being had to the submissions made by the parties, taking into consideration the fact that the co-accused persons have been granted bail by different Co-ordinate Benches of this Court and by the learned court below, petitioner is in custody since 08.07.2022 and charge sheet has already been submitted , as such, I am inclined to grant regular bail to the petitioner.
Let the petitioner, above named, be released on
Patna High Court CR. MISC. No.51780 of 2022(2) dt.09-12-2022 3/3 regular bail on furnishing bail bond of Rs. 25000 /- ( twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, City Court, Patna in connection with Didarganj P.S. Case No. 259 / 2020, G.R. No. 4445 / 2020.
