2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 314, 316, 318(4), 338, 340(2), 352, 351(2), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, opposite party no.2 deals in wholesale business of grains. In course of business,

Patna High Court CR. MISC. No.51563 of 2025(2) dt.20-08-2025 2/3 Rs.7,62,140/- had become due with one Vivek Kumar, who passed away on 9.4.2024. It is alleged that when informant approached petitioner no.1, who is wife of Late Vikek Kumar, all the accused persons abused and threatened the informant and refused to return the due money.

It is submitted on behalf of the petitioners that petitioner no.1 is wife of Late Vikek Kumar, petitioner no. 2 and 4 are brothers of petitioner no.1 and petitioner no.3 is father of petitioner no.1. Learned counsel submits that petitioner no. 2 to 4 are separate in mess and business and they are not not concerned with the alleged transaction made by late husband of petitioner no.1. Moreover, informant has not substantiated the alleged claim with any credit note/receiving of grains counter signed by Late Vivek Kumar. Petitioners claim clean antecedent.

5. Learned counsel for the State as well as the informant oppose the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate
