Petitioner seeks regular bail in connection with Rahui P.S. Case No. 137 of 2004 registered for the offence punishable under Sections 498A, 304B, 201/34 of the Indian Penal Code. As per FIR, there is allegation against the petitioner is of demand of dowry and taking his wife to Rajgir and thereafter killed her and disposed of her dead body.

Submission of learned counsel for the petitioner is that materials collected during the investigation clearly shows that she has committed suicide at her maternal house itself. He is in custody since 29.11.2018. Charge has already been framed against him.

Heard learned A.P.P. has also not controverted this

Patna High Court CR. MISC. No.50297 of 2019(4) dt.02-03-2020 2/2 fact however submitted that the allegation is of demand of dowry against the petitioner.

Considering the above, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 3rd Additional District and Sessions Judge, Nalanda at Bihar Sharif in connection with Rahui P.S. Case No 137 of 2004, with condition to cooperate in the disposal of trial and appear when required otherwise his bail bonds shall be cancelled.

Accordingly, this application is allowed.
