JUSTICE ARUN KUMAR ORAL ORDER 12-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.4.2018, seeks bail in Asarganj PS Case No. 29 of 2018 registered under Sections 302, 201 and 120B/34 of the IPC.

The allegation in brief is that the informant's younger brother was called by one Jitwa @ Boro for visiting the fair, next morning his dead body was found and suspicion is raised that accused persons including the petitioner entered into conspiracy and killed his brother buy strangulating.

Learned Counsel for the petitioner submits that the deceased was called by Jitwa from the home and not by the petitioner, only material transpired against the petitioner is that some witnesses saw him along with the deceased in the fair and in the confessional statement of one Pinku Upadhyay and this petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Goldan Mian @ Md. Mojahid is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Munger in connection with Asarganj PS Case No. 29 of 2018.
