2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 304/34 of the Indian Penal Code.

3. The prosecution story in brief is that 12-03-24 at about 04:30 p.m. the wife of informant namely Lilawati Devi, aged about 35 years went to Dr Sanjay Kumar's clinic near Brahima Mor to show her toothache. Due to the doctor's negligence and wrong and improper treatment, informant's wife died in the doctor's clinic. After that, the doctor's compounder brought his dead wife in a Bolero vehicle bearing registration no. B.R.29K-0103 to Sadar Hospital Gopalganj on the pretext of

Patna High Court CR. MISC. No.55672 of 2024(3) dt.01-10-2024 2/2 getting her treatment and thereafter he left her and fled away. Hence, the present F.I.R.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case due to party politics.

5. Learned counsel for the State opposes the prayer for bail and submits that wife of the informant died during treatment as she was suffering from toothache only. It is further submitted that condition of the deceased deteriorated only after injecting some medicine to her in his clinic. It is further submitted that without having proper degree qualification and experience, the petitioner treated the wife of the informant, as a result of which, she died.

6. Considering the submissions put forward by the parties, prayer for anticipatory bail of the petitioner stands rejected.
