====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 11-09-2025 Heard Mr. Md. Danish Quamar, learned counsel appearing on behalf of the petitioner and Mr. Aditya Narayan Sing. 1, learned A.P.P. for the State.

2. The present application has been filed under Section 482 of the Cr.P.C. for quashing of the F.I.R. in connection with Areraj P.S. Case No. 48 of 2024 registered for offences under Sections 341, 323, 324, 327, 504, 506 and 34 of the Indian Penal Code.

3. As per the allegation made in the FIR, petitioner in collusion with other accused persons had filled up soil on the land of the informant appertaining to Khata No. 57, Khesra No. 430 measuring total area 0.08 dhoor and had tried to

Considering the nature of allegation made in the FIR, as well as, the order dated 26.07.2018 passed in Title Suit No. 29 of 2017, which has been struck down by the learned Vth Additional District and Sessions Judge, East Champaran, Motihari vide order dated 31.05.2019 passed in Misc. Appeal No. 08 of 2018, I don't find that the petitioner has made out any case for interference.

5. However, considering the nature of allegation to be purely civil in nature, the parties may proceed to settle their dispute outside the court amicably by way of mediation.

6. The petitioner is directed to appear before the learned District Court on 19.09.2025 at 10:30 AM.

7. Learned District Court is directed to take necessary steps to refer the matter before the learned Mediator of the District Mediation Center.

8. Learned Mediator of the District Mediation Center concerned shall make his/her best efforts to settle the dispute amicably and thereafter submit his/her report before the concerned learned District Court, well within a period of three months, till then, no coercive action shall be taken against the petitioner in connection with the aforesaid case.

9. In case of failure on the part of the petitioner to appear on 19.09.2025 before the learned District Court or any date fixed by the learned Mediator, the interim protection granted to the petitioner shall automatically lose its force.

10. In case, the parties fail to reconcile, then in that case, the learned District Court shall proceed with the trial.

11. In case the parties resolve their dispute amicably, then the proceeding is required to be dropped.

12. Accordingly, the present quashing application stands disposed of.
