JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-02-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 427 and 302 of the Indian Penal Code. It is alleged that the petitioners assaulted to the husband of the informant with sickle whereas other co-accused assaulted with farsa and danda, subsequently the husband of the informant succumbed to the injuries.
It is submitted by learned counsel for the petitioners that the accusation has been levelled in the background of land dispute whereas petitioners' side also lodged a case at earlier point of time.
The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.8482 of 2015 (2) dt.27-02-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Manihari P.S. Case No. 39 of 2014 pending in the court of learned CJM, Katihar. Accordingly, the application is disposed of.
