JUSTICE RAKESH KUMAR ORAL ORDER 19-05-2016 Heard Sri Arvind Kumar Tiwary, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Uchakagaon P.S. Case no.53 of 2016 registered for the offence under Sections 272, 273, 420, 467, 468, 471/34 of the Indian Penal Code and Section 47(A) of the Excise Act, has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that the petitioner has been named as accused on confession made by the driver of the vehicle, from which huge quantity of country liquor was recovered. He submits that save and except confession of the driver, there is nothing on record to connect the petitioner in the present case.

No.19650 of 2016 (2) dt.19-05-2016 2/2 In view of facts and circumstances, let the petitioner, namely, Shambhu Pathak in the event of arrest or surrender within a period of six weeks from today be released on bail on furnishing bail bond of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IXth , Gopalganj in connection with Uchakagaon P.S. Case no.53 of 2016 subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
