JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-03-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Section 304B of the Indian Penal Code. The accusation is of killing the daughter of the informant after three years of the marriage for non-fulfilment of the dowry demand by throwing her from top of the roof. It is submitted by learned counsel for the petitioner that the victim received injury due to accidental fall from the roof when she was provided medical assistance also. The postmortem report reflects that due to infection on the wound on the head, the victim died on 03.10.2013 for which the complaint was filed on 21.10.2013 which came to be registered as a police on 28.10.2014. Considering the nature of accusation, this Court is not

Patna High Court Cr.Misc. No.12662 of 2015 (2) dt.26-03-2015 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected in connection with Bhabhua P.S. Case No. 537 of 2014 pending in the court of learned CJM, Kaimur at Bhabua.
