Mr. Ram Chandra Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 14-07-2021 Heard the parties in virtual Court proceeding. The report of the Superintendent of Police, Sitamarhi, dated 10.07.2021 at Flag-B, would reveal that effective steps for recovery of minor victim girl has been taken. The petitioner is languishing in custody for the offences punishable under Sections 363/366A/34 of the Indian Penal Code and Section 8 of the POCSO Act.

According to FIR the minor daughter of the informant went from the house for bringing grass for the animals but did not return. Later on the informant came to know that the victim was seen along with the FIR named five persons including the petitioner.

Learned counsel for the petitioner submits that concocted allegation is there as the victim voluntarily eloped

Patna High Court CR. MISC. No.7026 of 2021(4) dt.14-07-2021 2/2 with the brother of the petitioner. The petitioner is in custody since 26.09.2020.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Parihar P.S. Case No.72 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
