1. Heard Mr. Amir Alam, learned counsel for the petitioner and Mr. Md. Ataur Rahman, learned APP for the State.

2. The petitioner seeks regular bail in connection with Ahiyapur (Garha O.P.) P. S. Case No. 54 of 2025, dated 10.01.2025 registered for the offences punishable under Sections 80, 238 and 3(5) of the B.N.S.

The main submissions advanced by the petitioner's counsel are that though the instant matter relates to dowry death, however, this petitioner has been falsely roped in the alleged occurrence on account of being a relative of the husband of the deceased. It is submitted that he has been residing separately

No.50370 of 2025(2) dt.11-08-2025 2/2 from the deceased's husband for a long period and in this regard, a petition (Annexure-P/2) was filed before the S.S.P., Muzaffarpur, by the several co-villagers of the petitioner. It is further submitted that the deceased's husband is in jail. It is lastly submitted that in the FIR, there is no specific allegation against this petitioner.

4. Though learned APP appearing for the State has opposed the bail prayer of the petitioner but fairly accepts that there is no specific allegation against this petitioner, who is said to be the brother of the husband of the deceased.

5. Considering the aforesaid submissions advanced by the petitioner's counsel and mainly taking into account the petitioner's fair and clean antecedent and the completion of investigation against him, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Ahiyapur (Garha O.P.) P. S. Case No. 54 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of the Court concerned.
