2 This MJC application has been filed for transfer of GR Case No 2099 of 2016/Trial No 615 of 2016 arising out of Dhoraiya Police Station (for brevity, PS) Case No 180 of 2016. 3 Opposite Parties have appeared and correctly expressed an objection to the maintainability of the case as the matter arises out of a criminal proceeding.
4 Be that as it may, this Court, on going through the averments made in the application, also finds that no case is made out to warrant interference. The petitioner has raised apprehension
Patna High Court MJC No.616 of 2017 dt.09-08-2018 2/2 regarding his security in producing witnesses in the proceedings in the Court below arising out of Dhoraiya PS Case No 180 of 2016. It is stated in the petition that the petitioner is a practicing Advocate at the Civil Courts, Banka. Petitioner would be well advised to take steps for ensuring his security before the District Police Authorities. 5 No order need be passed in the instant application. This application is dismissed.
