The petitioner seeks bail in connection with Motipur P.S. Case No. 294 of 2020 instituted for the offences under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.03.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Allegation is of snatching of a bag containing Rs. 1,94,000/- and a laptop from the informant, further the informant claimed that he can identify the accused after seeing them.

Learned counsel for the petitioner submits that the F.I.R. was against unknown, the petitioner was arrested in

Patna High Court CR. MISC. No.61112 of 2021(2) dt.22-03-2022 2/2 Baruraj P.S. Case No. 214 of 2020 and was made to confess his participation in the crime and thus was remanded from Baruraj P.S. Case No. 214 of 2020 in the present case. Learned counsel further submits that despite being in custody, the petitioner has not been put on T.I.P. when the informant in the F.I.R. has claimed that he can identify the accused on seeing them. It is also submitted that no incriminating article was recovered from the petitioner connecting him with the offence. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-2nd West, Muzaffarpur in connection with Motipur P.S. Case No. 294 of 2020.
