JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A/504/323/34 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the informant died during pending of the present case as she was suffering from blood cancer. Father of the informant has filed a petition before the learned Sub-Divisional Judicial Magistrate, Madhepura to the effect that the informant was ready to compromise the case but it could not be compromised as she died on 29.04.2014 (as contained in annexure-2 to the petition). Considering the aforesaid facts, let the above named

No.15885 of 2015 (2) dt.16-04-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Madhepura in connection with Madhepura Mahila P.S. Case No.11 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
