JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-07-2018 The petitioner is apprehending his arrest in connection with Manihari P.S. Case No. 49/18, registered for offences punishable under Sections 147, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.

Allegation against the petitioner is of assault by sword to the informant causing injury.

It has been submitted on behalf of the petitioner that there is a case and counter case between the parties and petitioner has also received injury and there is mutation case pending between the parties.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case, nature of offence, I am not inclined to

Patna High Court Cr.Misc. No.40915 of 2018 (2) dt.16-07-2018 2/2 grant the privilege of anticipatory bail to the petitioner rather he should surrender before the court below and pray for regular bail and if any such application is filed, the court below shall decide the same on the merit of the case.
