The petitioners seek pre-arrest bail in connection with Mohammadpur P.S. Case No. 02 of 2016 registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code. Regard being had to the allegation that the petitioners assaulted the informant of the case with Lathi, Danda and Pharsa causing five injuries on his person, I am not inclined to grant prearrest bail to the petitioners no.1 to 3, namely, Indrajeet Rai, Santosh Rai and Ganesh Rai. Accordingly, their application for grant of pre-arrest bail is rejected.
Patna High Court Cr.Misc. No.21312 of 2016 (2) dt.25-05-2016 2/2 In case they surrender and seek bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
So far as petitioner no.4 is concerned, it has been submitted by the learned counsel for the petitioners that she being a lady has been made accused with omnibus and general allegation.
Keeping in view the submission made at the Bar, in the event of arrest or surrender in the court below within six weeks from today, the petitioner no.4, namely, Dhurpati Devi, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Mohammadpur P.S.Case No.02 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
