The petitioner apprehends his arrest in Shankarpur P.S. Case No. 120 of 2021, registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act. Prosecution case in brief is that on the disclosure of co-accused Bijendra Yadav who apprehended with arms and ammunition petitioner has been made accused in this case. It is submitted that no arms and ammunition has been recovered from possession of this petitioner. He is only alleged to have fled away from the place of occurrence after noticing the police party. Recovery has been made from possession of coaccused. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner above-

Case No. 120 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
