Petitioner, already in custody, seeks bail in connection with Kishanganj P.S. Case No.265 of 2017 registered under Section 392 of the Indian Penal Code.

It is the second attempt of seeking bail by the petitioner. His earlier prayer of bail was rejected vide order dated 16.02.2018 passed in Cr. Misc. No.1477 of 2018 on the ground that the looted motorcycle in the robbery was recovered from his house. Now the petitioner seeks bail on the ground that the petitioner has been in custody since 08.08.2017. Having considered the recovery of the robbed motorcycle from the house of the petitioner as well as his antecedent, the Court is not inclined to grant him bail, so again

Patna High Court Cr.Misc. No.42236 of 2018(2) dt.18-07-2018 2/2 the prayer of bail of the petitioner is rejected. However, the trial court is directed to expedite the trial.
