ANJANA MISHRA ORAL ORDER 22-09-2015 Learned counsel for the petitioners prays for and is granted leave to withdraw the case regarding Petitioner No.2 Sudhir Choudhary since he has been arrested. This application on his behalf is, accordingly, dismissed as withdrawn. Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Petitioner No.1 Dayanand Paswan is apprehending his arrest in connection with Bhagwanpur P.S. Case No.180 of 2014 for allegedly having committed the offences under Sections 341, 342, 323, 379, 504, 365 and 368/34 of the Indian Penal Code.

Earlier case diary in the present case was called for,

Patna High Court Cr.Misc. No.7555 of 2015 (4) dt.22-09-2015 2/2 which has since been received.

Considering the nature of allegations made against Petitioner No.1 and also there being no further cogent material available in the case diary, let Petitioner No.1, Dayanand Paswan, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Rakesh Kumar Dwivedi, learned Judicial Magistrate, 1st Class, Begusarai, in connection with Bhagwanpur P.S. Case No.180 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
