JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Chandramandih Police Station Case No. 07 of 2014 registered for the offences punishable under Sections 498A, 304B, 201/34 of the Indian Penal Code.
Petitioner no. 1 is son of sister-in-law of the deceased whereas petitioner no. 2 is married sister-in-law of the deceased and petitioner no. 3 is mother-in-law of the deceased. It appears from perusal of the first information report as well as impugned order that no specific overt act has been
Patna High Court Cr.Misc. No.9335 of 2015 (2) dt.09-03-2015 2/2 attributed against these petitioners and it is informed that husband of the deceased has already been remanded to judicial custody and moreover, the father-in-law of the deceased has already been granted regular bail by this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Jamui in Chandramandih Police Station Case No. 07 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
