JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-07-2016 Heard the Counsel for the petitioner and the Bihar State Food and Civil Supplies Corporation, Bihar.

This is second application filed on behalf of the petitioner seeking extension of time for complying with the conditions of grant of anticipatory bail vide order dated 09.07.2015 passed in Cr. Misc. No. 26232 of 2015. Petitioner having surrendered and paid the first installment as directed under the said order was released on provisional bail. He was required to deposit 10 % of the defalcated amount within six months. Before expiry of the period, the application being Cr. Misc. No. 5038 of 2016 was filed seeking extension of time which was considered and allowed vide order dated 03.02.2016 . In place of six months, the time was extended to nine months which expired on 09.04.2016. After the

Patna High Court Cr.Misc. No.19948 of 2016 (3) dt.13-07-2016 2/2 expiry of the period, the present application has been filed seeking further extension.

Counsel for the petitioner has explained the circumstances under which the present application is filed seeking further extension.

Considering the facts and circumstances, the application is allowed. Time granted under order dated 09.07.2015 passed in Cr. Misc. No. 26232 of 2015 is extended till 28th July, 2016 subject to further payment of cost in the sum of Rs. 1,000/- in the office of the District Manager of the Bihar State Food and Civil Supplies Corporation, Bihar and filing receipt thereof before the expiry of the said period.
