Section 26 of the Bihar Panchayat Raj Act, 2006 vests exclusive discretion in the District Election Officer who happens to be the District Magistrate for selection of polling booth. In my opinion in the nature of discretion so exercised by the District Magistrate as the District Election Officer it does not warrant any interference at such belated stage. No cause of indulgence is made out. The writ petition is accordingly disposed of (Jyoti Saran, J) SKPathak/- U
